MODUS GEMS operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). MODUS GEMS is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

SECTION 2 - OUR PRODUCTS AND CRAFTSMANSHIP We have made every effort to provide an accurate representation of our products and services. However, please note that colors or product appearance may differ from how they appear on your screen due to device settings.

For Bespoke and Custom Jewelry: All custom designs, including 3D renderings (CAD), are for representation purposes only. Due to the handcrafted nature of our jewelry and the unique characteristics of lab-grown gemstones, slight variations in final dimensions and appearance may occur. We do not warrant that the final custom product will be an identical match to digital renderings.

All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

SECTION 3 - ORDERS AND CUSTOM SALES When you place an order, you are making an offer to purchase. MODUS GEMS reserves the right to accept or decline your order for any reason at its discretion.

Custom and Bespoke Orders: All custom-made jewelry, engraved items, and specially sourced loose gemstones are considered FINAL SALE and are not eligible for cancellation, return, or exchange once production has commenced or the gemstone has been secured. Payment of a deposit or full balance constitutes your acceptance of the final design and these terms.

Ready-to-Ship Items: Purchases of non-customized stock items are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING Prices, discounts and promotions are subject to change without notice. Due to the fluctuating market price of precious metals and gemstones, MODUS GEMS reserves the right to adjust pricing at any time before an order is confirmed.

Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, or customs charges. For international orders, all import duties, taxes, and fees are the sole responsibility of the customer.

SECTION 5 - SHIPPING, RISK OF LOSS, AND SIGNATURE High-Value Delivery: Due to the value of our products, all jewelry shipments require an Adult Signature (21+) upon delivery. We cannot accommodate requests to leave packages at doorsteps or with unauthorized third parties.

Risk of Loss: All delivery times are estimates. Once the product is transferred to the shipping carrier (e.g., FedEx, UPS), the title and risk of loss or theft pass to the customer. We are not responsible for packages stolen after a confirmed delivery.

SECTION 6 - INTELLECTUAL PROPERTY All designs, trademarks, images, and custom CAD renderings are the exclusive property of MODUS GEMS. You must not reproduce, distribute, or modify any material on the Services without our prior written consent.

SECTION 12 - ERRORS AND OMISSIONS We reserve the right to correct any typographical errors or inaccuracies related to pricing or product descriptions and to cancel orders if information is inaccurate, even after an order has been submitted.

SECTION 21 - GOVERNING LAW These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of New York, United States. You consent to the exclusive jurisdiction of the state and federal courts located in New York County for any disputes.
